Include in the estate is the assets that the decedent owned individually. There are some assets that the decedent might have held with other individuals that are not included in the estate. The decedent might have had some assets that can be transferred by operation of law. Those are not included in an estate. Estate is only the assets the decedent owned individually that cannot be transferred by operation or law, or by the trust.
